Le vélo à Rouen, ce sera pour plus tard
Retoquée. La mairie doit recommencer toute la procédure qui l’a amenée à choisir la société Decaux pour la gestion du mobilier urbain, l’affichage publicitaire et la mise à disposition de 210 vélos gratuits. La procédure a en effet été annulée par le Tribunal Administratif de Rouen, suite à un recours d’une société qui n’a pas été choisie. Le motif est futile : une simple erreur de procédure de la mairie.
Mais la réalité est là : le marché prévu ne sera pas signé avec Decaux.
Toute la machine doit donc être relancée, et devrait aboutir, si l’on en croit les échéances prévues, avant le 31 juillet 2008. Le temps de réfléchir à nouveau à la solution choisie initialement ? Car, l’erreur de droit pourrait être profitable à tous si le temps qu’elle offre était mis à partie pour une meilleure articulation du projet rouennais avec les autres qui pourraient être menés à l’échelle de l’agglomération. Edgar Menguy disait, le vendredi 13 avril, en conseil municipal : “En ce qui concerne la politique du vélo, nous sommes tout à fait conscients des progrès à faire dans ce sens. Le projet porté par cette délibération est l’un des éléments d’un plan d’action vélo beaucoup plus vaste qui vous sera proposé prochainement. ”
Et bien voilà, à quelque chose malheur est bon : on peut espérer que ce “plan d’action vélo” bénéficie d’un temps de réflexion supplémentaire et d’une meilleure concertation avec les autres collectivités locales. Cela ne devrait malheureusement pas permettre à ces belles images de devenir réalité avant les prochaines élections municipales. Mais l’intérêt général ne vaut-il pas mieux que l’intérêt électoral ?

Quand au plan vélo, il était déjà prévu de l’aggrandir au fur et à mesure, maintenant j’espère que toutes les communes de l’agglo ont compris la nécessité de s’en doter un, ça va peut être permettre de faire avancer les choses plus rapidement. Est on sur au fait que l’ensemble des communes de l’agglo soit d’accord avec un plan vélo?
Pap> La décision du Conseil d’Etat relative à l’Espace Monet-Cathédrale n’est pas un événement d’importance comparable : le dossier attend d’être jugé sur le fond au Tribunal Administratif de Rouen. Et tant que cela n’aura pas été fait, on ne peut rien en dire de très interessant. Même pas qu’Yvon Robert n’aurait pas intérêt à agir sur le fond : d’ici là, la jurisprudence peut évoluer. Le droit n’est pas un matière figée. J’en parlerai, évidemment, quand on y sera. D’ici là, il n’y a pas vraiment de raison de commenter.
Pour le marché dont il est question aujourd’hui, le contexte est différent puisque toute la procédure de marché public va devoir ête relancée rapidement.
